National protocol to ensure the health and safety of company employees in the face of the COVID-19 epidemic

This protocol update applies from September 1 and stems from an opinion of the High Council of Public Health (HCSP), published on August 14, on the transmission of the virus by aerosols. In this opinion, the HCSP formulated the recommendation of the systematic wearing of masks in all public and collective private enclosed places.

The protocol will therefore make the wearing of a mask systematic in shared and enclosed spaces from the start of the school year.

However, in view of the diversity of organizations and working environments on the one hand and the diversity of the circulation of the virus in the territories, the Government wished to examine the exceptions and adaptations that could be made to the general principle of systematic wearing of the virus. mask in closed collective spaces. He again approached the HCSP which issued an opinion on August 28 on this subject.

On the basis of this opinion, the new national protocol specifies two cases that may be subject to an exemption from wearing a mask:

• When the employee works alone in his office;

• In the workshop, because employees are often required to perform more intense physical efforts than average, as soon as the ventilation / functional aeration conditions comply with regulations, and the number of people present in the work area is limited. , that these people respect the greatest possible distance between them and wear a visor.

The notice also allows a relaxation in the case of shared offices, in particular open space: an employee who is at his workstation may temporarily remove his mask if a certain number of criteria, the number of which will vary depending on the level. circulation of the virus in the department, are filled. It is excluded to remove the mask permanently throughout the day.

For activities that would prove incompatible with wearing a mask (for example, for oral interventions or public speaking for a limited period of time, in confined spaces respecting the defined organizational measures), the ministry continues the dialogue with social partners to monitor this implementation and define solutions.

Companies are encouraged, within the framework of social dialogue, to specify the methods of application of the protocol and to take into account specific business situations.

This protocol replaces the national deconfinement protocol and will gradually be implemented in companies.
